1.Scope and acceptance
These Terms of Service ("Terms") govern the use of listing.company (also reachable at listing.blun.ai), operated by Mayk Biletti, Sole Proprietor, Sportplatzgasse 32b, 2443 Leithaprodersdorf, Austria ("we", "us", "operator"). By creating an account or using any service of the platform you accept these Terms. If you act on behalf of a legal entity, you confirm authority to bind that entity.
2.Service description
The platform provides: (a) a public directory of businesses, (b) inquiry and contact mechanics between buyers and sellers, (c) the AI-powered Concierge for cross-border outreach and translation, (d) Trade Assurance escrow for cross-border payments, (e) a Bulk RFQ board with group-buy pooling, (f) supplier-tier ratings, and (g) optional paid plans (Pro / Trusted / Diamond). Specific features may be added, modified, or removed; we communicate material changes per Section 11.
3.Account, registration, security
Registration requires a valid email and acceptance of these Terms. You are responsible for keeping your credentials secret and for all activity from your account until you report a compromise. We may suspend an account that violates these Terms or that we reasonably believe is being used fraudulently. Verified-supplier status (Section 6) requires additional disclosure as described on /tiers.
4.Pricing, fees, billing
- Browsing the directory and contacting suppliers is free for buyers.
- Pro listing for sellers: €19/month, billed via Stripe.
- Trade Assurance: 1.5% take rate on the gross amount of completed escrow orders, deducted at release. No fees to the buyer beyond the order amount + applicable card processing pass-through.
- Bulk RFQ board, Concierge enquiries, and the public API are free for limited use; quotas are documented at /pricing.
All prices include applicable taxes where stated. The operator is a Kleinunternehmer pursuant to § 6 Abs. 1 Z 27 UStG and does not charge VAT on its own services. Payments through Mangopay and Stripe may carry separate processing fees disclosed at checkout.
5.Acceptable use
- No misrepresentation of identity, business name, or ownership.
- No publication of unlawful, infringing, defamatory, or misleading content.
- No automated scraping that overloads the API or evades documented rate limits.
- No use of the platform for spam, phishing, or harvesting personal data of other users.
- No circumvention of the Trade Assurance escrow for orders initiated through the platform — see Section 6.
Violations may result in immediate suspension. Repeated or material violations may result in account termination and reversal of any pending escrow holds.
6.Trade Assurance — escrow rules
Trade Assurance funds are held by Mangopay S.A., a Luxembourg-licensed e-money institution (PSD2-passported), in segregated client accounts at our partner bank — bankruptcy-remote from the operator.
- Funding: the buyer pays into the escrow wallet via Stripe (card / SEPA / bank).
- Holding: funds remain held until the buyer confirms delivery, the auto-release window expires (default 14 days from confirmed delivery), or a mediator decision is rendered.
- Release: on release, 1.5% take rate is deducted in favor of the operator, the remainder is paid to the seller's connected payout account.
- Disputes: either party may open a dispute during the holding window. A human mediator (operator team) reviews evidence and issues a binding ruling for funds release. Statutory consumer protection rights are not waived.
- Sample orders: sample-order flow uses the same escrow rails with a separate buyer-verdict step before bulk-price lock-in.
- Tier integrity: orders settled outside the platform do not count toward verified-trades / reviews / supplier tiers.
7.Intellectual property and content license
You retain all intellectual property rights to content you publish on the platform (listings, photos, messages, RFQs). By publishing, you grant the operator a non-exclusive, worldwide, royalty-free license to host, display, transmit, translate (via the in-house concierge), and index that content for the operation of the platform. You may revoke this license by deleting the content; backups may persist for up to 90 days.
Operator-authored content (UI, design, copy, code, taxonomy) remains the operator's property. Open-source components are governed by their respective licenses. The Mnemo memory engine that powers parts of the concierge is published under MIT.
8.Liability
- The platform is provided "as is" and "as available". We do not warrant uninterrupted operation, fitness for a particular purpose, or that any specific result will be achieved.
- For consumers (B2C) within the EU, statutory rights under the Austrian Consumer Protection Act (KSchG) and applicable EU consumer law apply unconditionally and are not limited by these Terms.
- For business users (B2B), liability for indirect damages, lost profits, and consequential damages is excluded to the extent permitted by law. Direct-damage liability is capped at the lesser of (a) twelve months' fees paid to the operator, or (b) €5,000 per incident.
- The cap above does not apply to liability arising from intent or gross negligence by the operator, nor to mandatory statutory liability that cannot be limited by contract.
9.Data protection
Processing of personal data is described in the Privacy Policy. Where we act as a processor for users (e.g. handling supplier data on behalf of a verified company), a Data Processing Agreement is available on request to blun.ai.app@gmail.com.
10.Term, termination, data export
Use is at-will. You may close your account at any time from the account settings. We may terminate for cause (violation of Section 5, fraud, repeated payment failure) or for convenience with 30 days' notice. On termination you may export all your data per Art. 20 GDPR; payment records subject to § 132 BAO retain for 7 years.
11.Modifications
Material changes to these Terms are announced 30 days in advance by email and on the platform. If you do not accept the changes, you may terminate per Section 10. Continued use after the effective date constitutes acceptance.
12.Governing law and jurisdiction
These Terms are governed by Austrian substantive law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, mandatory protective rules of their habitual residence remain unaffected (Art. 6(2) Rome I).
For B2B disputes the exclusive place of jurisdiction is Vienna, Austria. Consumers may bring proceedings at the venue of their habitual residence as provided by EU law.
13.Final provisions
- If any provision is invalid, the remainder remains in force; the invalid provision is replaced by the valid provision closest to its original economic intent.
- The contract language is English; the German version published at /legal/terms-de (when available) is for convenience; the English version prevails on conflicts unless mandatory law requires otherwise.
- EU online dispute resolution: ec.europa.eu/consumers/odr. We are not obliged to participate in arbitration before a consumer board.
